Terms and Conditions – FLIVÈRT
Article 1 – Applicability
1.1 These terms and conditions apply to all offers, orders, and agreements concluded via the FLIVÈRT webshop.
1.2 By placing an order, you accept these terms and conditions.
1.3 Deviations from these terms are only valid if agreed upon in writing with us.
1.4 All rights and claims stated in these terms also apply to third parties engaged by FLIVÈRT.
Article 2 – Offers and Agreements
2.1 An agreement is only concluded once FLIVÈRT has confirmed your order.
2.2 FLIVÈRT reserves the right to refuse an order or to attach conditions to the delivery, for example, if details are incorrect or if products are not in stock.
Article 3 – Prices and Payments
3.1 All prices are in euros and include VAT, unless otherwise stated. For second-hand items, no additional VAT is charged (margin scheme).
3.2 Payment can be made through the payment methods available in the webshop. Orders will only be processed once payment has been received.
3.3 In case of late payment, FLIVÈRT reserves the right to cancel the order.
Article 4 – Delivery and Shipping
4.1 We ship worldwide. Costs and delivery times are shown during the ordering process.
4.2 Products are shipped insured. Once your order has been handed over to the carrier, you will receive a tracking code.
4.3 Within the Netherlands, delivery usually takes 2–5 business days. For international shipping, longer delivery times apply.
4.4 Any import duties or additional costs for deliveries outside the EU are the responsibility of the customer.
4.5 If an item is unexpectedly unavailable, we will contact you immediately.
Article 5 – Retention of Title
Ownership of delivered products is transferred only after full payment has been received. Until then, ownership remains with FLIVÈRT. The risk of loss or damage passes to the customer at the moment of delivery.
Article 6 – Intellectual Property
All intellectual property rights to photos, texts, designs, and other materials on the webshop belong to FLIVÈRT or its licensors. It is not permitted to use, copy, or distribute any material without prior permission.
Article 7 – Vintage and Authenticity
7.1 FLIVÈRT exclusively sells vintage and second-hand items. These products may show signs of use. This is part of the character of vintage items and does not constitute a defect or reason for return.
7.2 We guarantee that all products are carefully selected and, where possible, checked for authenticity.
7.3 If you doubt the authenticity of a product, you may report this. FLIVÈRT can have the product examined by a third party. The costs for this are borne by the customer, unless otherwise agreed.
Article 8 – Warranty and Liability
8.1 No manufacturer’s warranty is provided on vintage products.
8.2 FLIVÈRT is not liable for indirect or consequential damages. Our liability is limited to the amount of the order, unless there is intent or gross negligence.
Article 9 – Force Majeure
In the event of force majeure (e.g., strikes, fire, disruptions, or delays with carriers), FLIVÈRT may suspend or dissolve the agreement. Compensation for damages is not owed in such cases.
Article 10 – Miscellaneous
10.1 FLIVÈRT may engage third parties to execute orders.
10.2 If any provisions of these terms prove invalid, the remaining provisions will remain fully in effect.
Article 11 – Applicable Law and Jurisdiction
All agreements with FLIVÈRT are governed by Dutch law. Disputes will be submitted exclusively to the competent court in the Netherlands.
